The Services are available only to and may only be used by persons who can form legally binding contracts under the applicable law. Without limiting the foregoing, the Services are not available to persons under the age of 18 or persons who have been suspended or terminated from using the Site.

In order to use the Site, you will be asked to provide certain personal information (Personal Information). You represent and agree that all Personal Information you provide will be true, accurate, current and complete and that you will update such information as necessary to maintain such information. Your user registration may not be transferred or sold to another party. If you are registering as a business entity, you represent that you have the authority to bind the entity to the Terms.

Each User is solely responsible for the accuracy, legality, currency and compliance of any information, advertisement, comment and material (Materials) which is posted on the Site and will be solely liable for false, misleading, inaccurate, infringing or other actionable material contained or referred to therein.

Each User is solely responsible for maintaining the confidentiality of its unique logon ID, and for its use. As traffic on this Site and in the discussion groups is monitored, evidence of use of the logon ID can be produced to support or defend any dispute or actionable cause or matter which arises in relation to the same.

Where Users collaborate with one another as a result of use of the Site or the discussion groups, they do so as independent contracting parties. Users acknowledge that the Freejini will not in any way be construed as a party to such collaboration nor be liable nor responsible in any way for the dealings of such collaboration or the parties to such collaboration.

Searching sales advertisements and deals on the Site is free. Sales advertising is chargeable at a Fee based on our Packages and subject to our approval. Information on our Packages and Fees can be found on https://freejini.com.my/advertise#howToAdvertise.

Advertisers refer to a third party seller of goods of services who are Users of the Site and Services to post an advertisement and who may provide discount vouchers or codes. Advertisers shall not list advertisements where no sales apply to their store. Your advertisements may only include text descriptions, graphics, pictures and other content relevant to the sale of that item.

We receive the right to remove any Materials or advertisement without prior notice to you where:

1. the Advertisers registration details and contact information is in-valid, false, not contactable or misleading;
2. it contains statements which are inaccurate or fake;
3. we receive a complaint or become aware that the advertisement or any part of the advertisement infringes the intellectual property rights of a third party;
4. the Advertiser has been suspended for any other reasons; or
5. the advertisement is in breach of the Terms.

Materials and your activities on the Site including listing of sales advertisements shall not:

1. infringe a third party's intellectual property rights including but not limited to copyright, patent, trademark, trade secret or other proprietary rights;
2. be false, inaccurate or misleading;
3. be fraudulent or involve the sale of counterfeit or stolen goods;
4. be for the sale or trade of endangered species;
5. violate any law, statute or regulation (including, but not limited to, those governing, consumer protection, unfair competition or false advertising);
6. be defamatory, trade libelous, unlawfully threatening or unlawfully harassing;
7. be obscene, contain profanity or contain pornography;
8. promote sales of products or services that cause damage, harm, or injury such as but not limited to drugs and illegal recreational and psychoactive substances; equipment to facilitate drug use; weapons, ammunition, explosive materials and fireworks; instructions for making explosives or other harmful products and tobacco products;
9. contain or promote hatred, violence, harassment, bullying, racism, sexual, religious, or political intolerance;
10. contain promotion of products or services that are designed to enable dishonest behavior such as but not limited to hacking software or instructions; services designed to artificially inflate ad or website traffic, fake documents and/or academic cheating services;
11. contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;
12. create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers; and
13. link directly or indirectly to or include descriptions of goods or services that are prohibited under the Terms and to which you do not have a right to link to or include.

Furthermore, you may not list any Materials on the Site (or consummate any transaction that was initiated using our Services) that, by paying to us the Fee, could cause us to violate any applicable law, statute or regulation or that violates the User Restrictions.
Without limiting other remedies, we have the right to limit your activity, immediately remove your advertisements, warn the Users of our Site of your actions, issue a warning, temporarily suspend, indefinitely suspend or terminate your registration as a User or refuse to provide our Services to you if:

1. you are in breach of the Terms;
2. we are unable to verify or authenticate any information you provide to us; or
3. where we believe that your actions or continued use of the Site may cause financial loss or legal liability for you, other Users or us.

The User agrees to grant Freejini a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise copyright and database rights you have in the Materials and Personal Information so that we are not violating any rights you might have therein.

You may not take any actions which may undermine the integrity of the comment section of the Site such as leaving positive comments on your posted advertisement using a secondary or third parties User IDs, leaving negative comments on other Users advertisement using a secondary or third party account or for the purpose of enabling positive comments to be left about you. We reserve the right to remove any Users positive or negative comment at our own discretion.

Each User agrees to indemnify and keep indemnified Freejini, their successors and assigns, and each of their respective directors, officers, employees and agents from and against (or with avoiding) any and all liability, damages, losses, claims (including reasonable legal fees) resulting in any way from its use of and from any Materials and Personal Information posted on the Site, to its discussion groups or from any other matter relating to its participation herein including but not limited to use of the information contained on the Site, from discussion groups or arising from any introduction or collaboration resulting therefrom or otherwise arising from using the Site.
Each User waives any right to bring any claim or action against Freejini for any loss, damage or injury arising from use of the Site or any Materials and Personal Information from the Site or from these Terms.

In the event any action arises under this clause, Freejini may during any such action, bar the User access to the Site until such time as we are certain, in our reasonable opinion, that there is not likely to be a claim under such indemnity or the claim has been resolved.

The Site is as a platform which allows the User to search or posts sales advertisements. We are not involved in any transactions between the Users. We do not warrant the content, accuracy or veracity of any Personal Information and Materials, the responsibility for which rests with each of the User. Specifically, we do not guarantee that any products, services, discount coupons or codes including QR Codes and bar codes and promotions of the Advertisers are at all times up-to-date. We advise you to check prior to making your purchase with the Advertisers.

Each User accepts the Site AS IS with any faults or failings and without any representation, warranty or guarantee whatsoever, express or implied, including without limitation any implied warranty of accuracy, completeness, quality, merchantability or fitness for a particular purpose.

We cannot guarantee continuous or secure access to the Site and operation of the Site may be interfered with by numerous factors outside of our control.

We do not control the information provided by other users that is made available through our system. You may find other user's information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and practice safe trading when using the Site. Please note that there are also risks of dealing with underage persons or people acting under false pretense. Additionally, there may also be risks dealing with international trade and foreign nationals. By using this Site, you agree to accept such risks and we are not responsible for the acts or omissions of users on the Site. We use many techniques to verify the accuracy of the information the User provides us when they register on the Site. However, because user verification on the Internet is difficult, we cannot and do not confirm each User's purported identity.

In no event will Freejini, their successors and assigns, and each of their respective directors, officers, employees and agents be liable for any injury, loss, claim, damages or any special, incidental, consequential, exemplary or punitive damages of any kind arising out of or in connection with any Users access to, or use of the Site, any Personal Information and Materials thereon or any goods, materials or services available therefrom, whether based in contract, tort and whether negligent or otherwise, even if Freejini has been advised of the possibility of such damages. In the event that this exclusion of liability is held by a court of competent jurisdiction to be unlawful, but that liability may be lawfully limited, Freejinis aggregate total liability to any User for all such damages and losses shall be limited to the Fee paid by the User suffering loss during the twelve months preceding the event giving rise to liability.

Freejini exclusively retains ownership of all intellectual property rights in the Site including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, trademarks, trade names, service marks, designs, know-how, trade secrets and inventions (patentable or not), goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks, unless the same is explicitly mentioned to be owned by a third party.

Other than the rights expressly provided in the Terms the User obtains no rights whatsoever in the Site or its content (including any ownership rights), by or through your use of the Site.

You must not do anything that infringes, threatens to infringe or otherwise jeopardizes the rights of Freejini in the Site and the content. This means that without limitation and subject to any exceptions stated in the Terms, you may not copy, reproduce, distribute, republish, download, display, post, transmit, sell or otherwise use in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, any content in the Site including Freejinis intellectual property rights without the prior written permission of Freejini.

You are allowed to share the Advertisements on the Site with third parties by clicking on the Share button under the relevant Advertisements.

All other trademarks not owned by Freejini that appear on the Site are the property of their respective owners which we do not have control over and we claim no responsibility for such content generated. Unless specifically stated otherwise, reference to any products, services, or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by us.

If you believe that your own work, or the work of a third party for whom you are authorized to act is featured on this Site or has been otherwise copied and made available on this Site in a manner that constitutes intellectual property rights infringement, you should liaise with the relevant Merchant directly for such infringement issues and inform us of the same. We will promptly remove or disable access to the Material.

You acknowledge and agree that Freejini may from time to time work with our partners to send you promotional messages, deals or information from our sponsors. Freejini will for all practical purpose allows Users to unsubscribe from receiving such materials.

The Site may contain links to third party web sites or programs that are not controlled by or affiliated with the Site. Freejini is not responsible for the content, offers or privacy policies of such sites and programs, including, without limitation, your redemption of such offers or an Advertisers refusal to honour any offer. We shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, advertising, services, products, or other materials on or available from such third-party websites. Your dealings with third party sites are solely between you and the applicable third party.

Freejini may disable links to any third-party website that you or others post on the Site.

You hereby acknowledge that any transaction or purchase which you conclude with the Advertisers shall be between you and the Advertisers and you acknowledge and agree that Freejini is not responsible or involved in such transaction or purchase in any way. You are advised to check on any discounts that have been applied in an advertisement prior to committing to any purchase.

Offers (including those provided by way of bar coding or QR Codes) are provided by Advertisers and Freejini does not guarantee that the said Offers are valid. Freejini is not responsible for the content, offers or privacy policies of such Offers including, without limitation, your redemption of such Offers or an Advertisers refusal to honour them. We shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on such Offers.

Freejini and the User are independent contractors and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by the use of the Site and Services.

Except as explicitly stated otherwise, any notices shall be given by e-mail to enquiry@sales.my (with regards to Freejini) or to the e-mail address you provided to Freejini during the registration process (in your case), or such other address as the party shall specify. The notice shall be deemed to have been given 24 hours after the e-mail is sent, unless the sending party is notified that the e-mail address is invalid or undelivered. Alternatively, we may give the User notice by registered mail to the address provided to Freejini during the registration process.

You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of the Site. Users agree that this Terms and any dispute arising in any way in relation to the Site shall be governed by and construed in accordance with the applicable laws of Malaysia.

Freejini cannot be held liable for breach of any of our obligations under the Terms wherein we are hindered or prevented from carrying out our obligations by any cause outside of our reasonable control including lightening, fire, flood, severe weather, strike, lockout, labor dispute, act of God, war, riots, civil commotion, malicious damage, failure of telecommunications or computer systems, compliance with law, accidents etc.
